Draft seeks to lowerage of criminal responsibility to 12

刑法修正案草案拟下调法定最低刑责年龄至12岁

The age ofcriminal responsibility in China is expected to be lowered to 12 in somespecial situations in accordance with a draft amendment to the Criminal Law.

根据刑法修正案（十一）草案，中国法定最低刑责年龄拟在一些特定情形下下调至12岁。

Theamendment was submitted to the bimonthly session of the National People'sCongress Standing Committee, China's top legislature, for a second review onTuesday.

该修正案草案已于周二（10月13日）提交至中国最高立法机关——全国人大常委会两月一次的会议进行第二次审阅。

The draftsays children aged from 12 to 14 should shoulder criminal responsibility ifcharges of intentional homicide or intentional injury causing deaths or incruel circumstances are approved by the Supreme People's Procuratorate.

草案规定，已满12周岁不满14周岁的儿童，犯故意杀人、故意伤害罪，致人死亡，情节恶劣的，经最高人民检察院核准，应当负刑事责任。

The age ofcriminal responsibility is currently 16, with people aged between 14 and 16only held criminally liable if they commit serious violent offenses, such asintentional homicide, rape or robbery. Those under the age of 14 who commitcrimes can be exempt from criminal punishment.

目前，我国刑事责任年龄为16周岁，已满14周岁不满16周岁的人只有犯下故意杀人、强奸、抢劫等严重罪行时才须要负刑事责任。而14周岁以下的犯罪者可以免于刑事处罚。

"Theage-related change in the draft amendment is due to several serious violentoffenses committed by very young people that shocked the nation and arousedpublic concern," Zhou Guangquan, a member of NPC's Constitution and LawCommittee, said when introducing the draft to lawmakers on Tuesday.

全国人大宪法和法律委员会委员周光权周二向委员们介绍该草案时表示：“修正案草案中针对刑事责任年龄的调整，是因为诸多震惊全国、引发公众关注的儿童恶性犯罪案件。”

He said italso stipulates that people with special responsibilities, including thoseguarding, adopting, looking after, educating or offering medical aid tojuveniles, will be held criminally liable if they have sex with girls aged from14 to 16, irrespective of whether it's consensual.

他表示，草案中还规定，对负有监护、收养、看护、教育、医疗等特殊职责人员，与已满14周岁不满16周岁未成年女性发生性关系的，不论未成年人是否同意，都应追究刑事责任。
